Terms of Service

1. Agreement to Terms

By accessing or using Curated ("the Service", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Curated.

2. Age Requirement

You must be 18 years of age or older to use Curated. By creating an account, you represent and warrant that you are at least 18 years old. We do not knowingly allow minors to use the Service. If we learn that a user is under 18, we will terminate their account immediately.

3. Prohibited Content

The following content is strictly prohibited on Curated and will result in immediate account termination and, where required by law, reporting to the appropriate authorities:

  • Child sexual abuse material (CSAM) — Any depiction, real or simulated, of a person under 18 in a sexually explicit manner. This content is illegal under federal law (18 U.S.C. § 2256) and will be reported to the National Center for Missing and Exploited Children (NCMEC) and law enforcement without exception.
  • Non-consensual intimate imagery ("revenge porn") — Sharing intimate or sexual images of any person without their explicit consent.
  • Nudity and explicit sexual content — Curated is a non-explicit platform. Nudity, pornography, or overtly sexual content is not permitted.
  • Harassment and abuse — Targeted harassment, threats, doxxing, stalking, or content designed to intimidate, harm, or degrade any individual or group.
  • Hate speech — Content that promotes violence, discrimination, or hatred against any person or group on the basis of race, ethnicity, nationality, religion, gender, sexual orientation, disability, or other protected characteristics.
  • Illegal content — Any content that violates applicable local, state, national, or international law.
  • Spam and deceptive content — Automated posting, fake engagement, misleading metadata, or impersonation of any person or entity.
  • Malware and phishing — Links or content designed to harm devices, steal credentials, or deceive users.
  • Copyright-infringing content — Content that infringes the intellectual property rights of any third party. See our DMCA Policy for details.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@curated.art if you believe your account has been compromised. We may terminate accounts that violate these Terms at our sole discretion, with or without notice.

5. User Content

By uploading or posting content to Curated, you represent and warrant that:

  • You own the content or have all necessary rights and permissions to post it.
  • The content does not violate the rights of any third party.
  • The content complies with these Terms and all applicable laws.

You grant Curated a non-exclusive, royalty-free, worldwide license to display, distribute, and promote your content within the Service. You retain ownership of your content.

6. Content Moderation

We use automated tools (including image recognition APIs and perceptual hashing) and human review to detect and remove prohibited content. All uploaded images are scanned before being published. We reserve the right to remove any content and suspend any account at our sole discretion.

CSAM Detection and Reporting: We use industry-standard tools including PhotoDNA and the NCMEC CyberTipline to detect and report child sexual abuse material. We are legally required under 18 U.S.C. § 2258A to report any detected CSAM to NCMEC. Uploading such content will result in immediate account termination and reporting to law enforcement.

7. Reporting Violations

If you encounter content that violates these Terms, please use the "Report" button on any pin, or contact us at abuse@curated.art. We review all reports and take appropriate action.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, Curated shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you shall not exceed the amount you have paid to us in the past twelve months, if any.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario, Canada. If you are accessing the Service from the United States, you acknowledge that certain US federal laws (including 18 U.S.C. § 2258A regarding CSAM reporting) may also apply.

11. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes your acceptance of the updated Terms. We will update the "Last updated" date at the top of this page when changes are made.
